That,“Kailash Kumar Photography” (herein after mentioned as KKP, for brevity and convenience) is a website-based service for high definition pre clicked photographs being available for use against a payment. That, all other related websites, software, mobile apps, and other services offered either by KKP directly, or through third party collaboration shall be deemed to be governed by these Term sand Conditions of Usage.

That, it is expressly provided for that by using this website, you agree to the terms and conditions, and privacy policy, of the“Kailash Kumar Photography” (herein after mentioned as KKP, for brevity and convenience). If you do not agree to either the terms and conditions or the privacy policy, please stop using this website with immediate effect. Any usage of the Website amounts to deemed acceptance of terms and conditions, and privacy policy.

That, these Terms and Conditions of Usage (TCU) are binding on each User and that, the same is intentional of formulating and by express action of the user of using the website is deemed to constitute a binding agreement which is otherwise enforceable in law. There fore, by using this website, the user admits to having read the terms and conditions of this agreement and also be bound by this TCU.

That, KKP reserves the right to change these terms and conditions at any point of time, without any prior notice

That, KKP puts user to the notice that these terms and conditions are governed by a force majeure clause.

That, the user has the option of creating a user account on the website so that certain additional functions of the website-based services can be accessed, the user understands the same and also understands that the collection of data shall be governed by the Privacy Policy of KKP.

That, the user understands that the entire intellectual property which is otherwise owned by KKP may be visible to the user by means of the said website. However, for all practical purposes, KKP shall continue to be the sole owner of all right, title, and interest in such Intellectual Property, whether registered or not, and that, the user shall be duty bound to take all necessary steps as are required under the law. That, without limitations, KKP makes it clear that the said intellectual property in form of designs, copyright, patents, trademarks, geographical indicators, circuit designs, etcetera, is protected under the requisite law in appropriate jurisdictions and that, any breach infringement there of shall be punishable with the applicable law. That, the user to avoid such action for breach / infringement which may otherwise be initiated by KKP, shall necessarily license the content to themselves by apply in to KKP and by purchasing the usage rights.

That in any case / contingency, the user waives the right to initiate any infringement / breach claims against KKP. That, the user expressly waives the right to initiate and sustain such an infringement /breach action. The user shall be at liberty to serve KKP with a cease and desist notice and that shall be the end of the user’s statutory and / or common law rights.

The user understands that the use of this website is not error free and in case of any untoward incident, resulting from the authorised unauthorised usage of this website, KKP shall not be responsible for the same. The same includes but is not limited to virus attack, third party websites, loss of money over payment portals, et cetera.The user indemnifies KKP from all such liability which may arise and states that KKP shall not be responsible for the same

That, in case of any dispute arising out of the currency of these terms and conditions and / or relating to its interpretation, the same shall be referred to a sole arbitrator to be appointed by KKP upon are quest in writing. That such arbitration proceedings shall be in English and the seat of arbitration shall be Sheoganj. That, the proceedings shall strictly follow the CPC and that, the arbitrator-so appointed shall have a mandate for a period of one year. That, the proceedings / appointment shall be governed by the Arbitration and Conciliation Act, 1996 along with the 2015 amendment, or its subsequent enactment, as the case may be.

That, these terms and conditions shall be read in consonance with all the laws prevalent in India as would otherwise be applicable in the territorial limits of Sheoganj (Rajasthan, India).

That, these terms of use and / or privacy policy shall prevail over all other contrary, non enforceable agreements, rules, covenants, etcetera, and in case of any dispute inter se, the terms and conditions of this terms of use shall prevail over the privacy policy.

Terms of Use for Photography

Personal Use: Customers and clients are allowed to use the photographs taken by Kailash Kumar Photography for their personal use. This includes displaying the photos in personal albums, frames, or sharing them with family and friends through personal social media accounts.
Single Client Use: The use of the photographs is permitted for one specific client or project only. This means that if you have commissioned Kailash Kumar Photography for a specific project, you are allowed to use the photos for that particular client or project, subject to the other terms of this policy.
Usage Rights: Clients are granted extensive usage rights for the photographs taken by Kailash Kumar Photography. The photos can be utilized on personal and business websites, e-books, web posts, print media, posters, glow sign boards, or in advertisements, provided it is within the context of the single client for whom the photography was originally conducted.

Prohibition of Resale: Under no circumstances are customers or clients allowed to sell the photographs taken by Kailash Kumar Photography on any stock website or any platform anywhere in the world. The photographs are strictly for personal or single-client use, as outlined in points 1, 2, and 3.

Note: All other rights to the photographs, including copyright and intellectual property rights, remain the sole property of Kailash Kumar Photography. Unauthorized use, reproduction, or distribution of the photographs beyond the scope of this policy is strictly prohibited and may result in legal action.

By availing the services of Kailash Kumar Photography, you agree to abide by these terms and use the photographs responsibly within the specified boundaries of personal and single-client use.
